  • "The effort by Clerk of Orphan’s Court Theresa Santai Gaffney to pursue intervention to appeal the Whitewood decision had proceeded to the Supreme Court.  Her petition to the U.S. Supreme Court for a stay of the Whitewood decision was denied on July 9th by Justice Alito, who is responsible for matters filed in Third Circuit cases."

  • "Santai-Gaffney’s attorney, Randy Wenger, with the Independence Law Center, said the legal group is considering its next steps.  'We believe Theresa is a proper party and we believe that intervention is appropriate,' he said. 'She’s an elected official charged with carrying out the marriage law. Therefore, she has a unique interest in the judicial review of this law. So, this is not the end of the road for us and it shouldn’t be. The people of Pennsylvania deserve to have adequate review of this law.'"

    While both Senator Casey and Senator Toomey identify themselves as Catholic, neither is co-sponsoring the Marriage and Religious Freedom Act (S 1808) or the State Marriage Defense Act (S 2024).  No Catholic member of the House of Representatives from the Archdiocese of Philadelphia (i.e., Bob Brady, Mike Fitzpatrick, Pat Meehan) is co-sponsoring the Marriage Protection Amendment (HJ Res 51), the Marriage and Religious Freedom Act (HR 3133), or the State Marriage Defense Act (HR 3829).

    You can email Sen Casey, Sen Toomey, Rep Brady, Rep Fitzpatrick, and Rep Meehan - with copies to the archbishop and his auxiliary bishops - requesting co-sponsorship/support of HJ Res 51, HR 3133 / S 1808, HR 3829 / S 2024.
